USCIS released a new I-9 form for employment eligibility verification on July 17, 2017 which must now be used. As of September 18, 2017, this new version of the I-9 form is now required and replaces the November 14, 2016 version of the I-9 form.  Some of the changes, on the revised form, include a name change of the Office of Special Counsel for Immigration-Related Unfair Employment Practices to Immigrant and Employee Rights Section.  Also of note, the phrase “the end of” was removed from the phrase “the first day of employment.”

In addition, there have been changes to the list of documents that will be acceptable to verify employment to include: Form FS-240 “Consular Report of Birth Abroad;” Form FS-545 and DS-1350 can now have combined certifications of report of birth and will be in Section C #2 in List C; and all List C documents were renumbered except for the Social Security Card.

It is worth noting all previous storage and retention mandates for all previously completed I-9 forms are in effect. In addition, the revised Handbook for Employers: Guidance for Completing Form I-9 can be used to assist employers in completing the new version of this very important document.
