A special needs trust (SNT) allows and preserves a person with a disability to receive gifts, settlements, inheritance, and more without losing his or her eligibility for government benefits programs, benefits and subsidies.
An SNT is also called a supplemental needs trust because a special needs person does not own the assets in the special needs trust, they can remain eligible for these benefit programs that have asset limits.
The Estate Planning group of Davison Eastman Muñoz Paone, P.A. is well-experienced with special needs trusts, guardianships, powers of attorney and more. We maintain intimate understanding of, among other things, how to use SNTs to retain and maintain Social Security and/or Medicaid benefits and enhance a special needs person’s life.
Proceeds from this type of trust cannot be used for food or housing expenses, however, they may be used by way of example, medical expenses, payment of caretakers, transportation, entertainment, computers and more.
