Timothy Moriarty is a litigator and trial lawyer handling a wide variety of civil and criminal cases at all levels of the state and federal courts. He is also experienced in handling alternate dispute resolution and administrative processes.
His practice includes a broad spectrum of complex commercial litigation. His clients range from start-up sole proprietorships to large corporations, general defense litigation, insurance coverage litigation, construction litigation, trusts and estate litigation and criminal defense. Timothy has successfully negotiated hundreds of settlements directly in all types of litigation, and drafted numerous complex settlement agreements, releases, and nondisclosure agreements.
Highly experienced in all aspects of criminal defense, Timothy has handled a myriad of casing, including pre-indictment investigations, arrest, arraignment, grand juries, pleas, discovery, pretrial hearings, trials, jury selection, evidence, motions, and post-trial remedies.
This broad and extensive experience has enabled Timothy to effectively represent individuals and entities in civil enforcement actions brought by governmental entities such as the Bureau of Securities, Division of Consumer Affairs, and the Attorney General’s Office.
Timothy has substantial Appellate experience. Timothy has broad knowledge of appellate cases as well. His Appellate experience includes: Constitutional rights cases involving the constitutionality of the State’s request for a person’s mobile phone passcode without the provision of any Miranda warnings, all matters of probate involving issues such as undue influence, testamentary capacity, and exercise of a power of appointment and choice of law provisions.
A native of Long Branch, NJ, Tim attended Seton Hall Law School, graduating magna cum laude. He was selected for inclusion in the Order of the Coif, a national honors society for his academic achievement.
During law school Tim served as judicial intern to the Honorable James R. Zazzali, Associate Justice, Supreme Court of New Jersey. After law school, Timothy served as appellate clerk for the Honorable for Mary Catherine Cuff, Superior Court of New Jersey, Appellate Division.
Before coming to DEMP, Tim worked at Coughlin Duffy, LLP; Proskauer Rose LLP; Bubb Grogan Cocca, LLP. He spent the past 9 years at The Moriarty Law Firm as Managing Partner of Litigation and Appellate Practice.
